All of our products are designed to fail when over stressed.

MADE TO ORDER ITEMS:

We rely on the accuracy of your measurements when ordering made-to-measure products. We do not accept liability for any inaccurate measurements provided by you. Made-to-Order Products will be made specifically to your order in accordance with the instructions and specifications you have given us.
It is your responsibility to check all details and aspects of your order are correct and suitable for your requirements, including measurements, dimensions, Product features and delivery. It is the buyers responsibility to assess the suitability of the product for its intended use and to arrange safe installation and use of the product. Jenny Gutierrez Limited accepts no liability for any claim arising from the unsuitability or misuse of any of our products or from faulty installation of our products.

PRODUCT DESCRIPTIONS & COLOURS:

Every effort is made to ensure that the Products we supply correspond as closely as possible to the samples shown on this Website but they might not be exactly the same. We regret that no responsibility can be accepted for these slight variations which all add to the unique features of our Products including but not limited to the following:

• All measurements are approximate, please allow +/- 2cm variance on sizes stated.
• Every reasonable effort is made to ensure the accuracy of colour representations, colour may vary in accordance with the settings of your monitor, software, or printer.

PRICES & PAYMENT METHODS:

All prices are in Pounds Sterling and are inclusive of VAT at the current rates but excluding delivery charges.

Customers outside of the UK are responsible for all local taxes, customs charges and import duties on their order and these are not included in the purchase price.

Jenny Gutierrez Limited currently only accepts payment via credit/debit card or via paypal.

No order is binding on you or Jenny Gutierrez Limited until we have accepted it and received payment in full. All title and ownership to the ordered Goods will pass to you from the moment they are dispatched by us to the postal service, or to our carriers, or on payment in full by you of the price of the Goods and any delivery charge (if applicable); and risk will pass on delivery.

CANCELLATIONS, RETURNS & REFUNDS:

ORDER CANCELLATIONS:

Standard Products: You have the right to cancel your order at any time before you receive the products you ordered. If these Products have already been dispatched when you contact us, you will be advised to return them upon delivery at your own expense.

Made-To-Order Products: If you need to amend or cancel your order for Made-to-Order Products you are entitled to do so at any time up to 48 hours after you have placed your order. If you amend or cancel your order more than 48 hours after you placed it, we reserve the right to charge you any costs we incur in relation to your order.

REFUND POLICY

We will be happy to refund or exchange any unused Jenny Gutierrez Limited product that is returned to us in its original packaging, in the condition in which you received it, together with proof of purchase within 28 working days of notification of the intention to return the item. This excludes items made to order / made to your specifications. Due to hygeine reasons, this also excludes earrings.

This does not affect your statutory rights.

RETURNS / REFUNDS:

Standard Products: You can return any unused product ordered up to 7 Working Days commencing from the day after receipt of the Products, by contacting us in writing within the 7 working day period and we will refund any payment that you have already made upon receipt of the returned item within 28 days in its original packaging and condition. We request that any such cancelled Products are returned to us within 28 Working Days of the date of cancellation.
If you return Products by post, please ensure you package and label them properly so that they are not lost or damaged in transit. We recommend you insure the item and retain some proof of postage in the event that the Products go missing, as Products remain your responsibility and property until we receive them.

Please note that Royal Mail 1st class signed for delivery does not insure jewellery items. Royal Mail Special delivery currently insures jewellery valued up to £1000 and we recommend that you use this service as a minimum.

Made-to-Order Products cannot be returned after you have received them, unless they are defective.

COMPETITION PRIZES:

We do not accept returns of competition prizes. No refunds will be offered for competition prizes and their purchase price will be stated as £0. Competition prizes may not be exchanged. No cash alternatives are available to the prize offered. No partial refund will be given if the competition prize chosen by the winner is less than the stated value of the available prize. Jenny Gutierrez Ltd Gift Vouchers won in competitions may be used in part payment for an item of greater value than the value of the gift voucher. If a gift voucher is used in part payment, only the additional payment will be eligible for a refund and not the value of the gift voucher.

DELIVERY:

In cases of items returned to us due to failed delivery it will be the customers responsibility to arrange and pay for re-delivery.

DELIVERY TIMES

Delivery times are estimated are not guaranteed however we will do our utmost to ensure goods are delivered within the stated time. We shall not be liable for delays or failures in delivery caused by a failure to gain access to the delivery address on the agreed delivery date or failure to obtain a signature or because of other circumstances beyond our reasonable control. Specific delivery times and days cannot be agreed at any time in the order process.

RISK & PROPERTY:

We carry the risk of loss or damage to the Products until you receive them. If you return the Products to us for any reason, they will become our property and be at our risk from the time at which we receive them. UNDELIVERED ITEMS: An item is only considered to be lost in the mail when it has remained missing for the period of time specified by the mail carrier and is confirmed as missing by the mail carrier. When an item is confirmed as missing by the mail carrier the customer will receive a replacement where available or a refund from the proceeds of the mail carriers compensation scheme.
